These Terms of Use ("Terms") govern your use of https://face-moisturizer.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

What the Site is, and what it is not

The Site publishes general information about face moisturizer: skin types, applying moisturizer, humectants, emollients, and occlusives, ingredients such as hyaluronic acid and ceramides, fragrance labels, textures, moisturizers with SPF, sunscreen, cosmetic and drug claims, ingredient lists, label terms, testing a new product, and shelf life. We are not a retailer, a brand, a maker, a pharmacy, a testing laboratory, a government agency, a doctor, a dermatologist, a medical provider, or a lawyer. We do not sell moisturizers, sunscreens, or any other product. The Site does not give product picks, prices, ingredient amounts, or treatment plans.

Important skin care and health notice

Skin care products, including moisturizers, and sunscreens can cause irritation, rashes, and allergic reactions, and some reactions can be serious. Nothing on the Site is a diagnosis, a treatment, or a substitute for care from a doctor or dermatologist. You are responsible for which products you choose and how you use them, for testing a new product before you use it on your face, for following the directions and warnings on each product's label, and for getting medical help when you need it. If you have a rash, a skin reaction that does not go away, or any skin condition, see a doctor or dermatologist. If you have signs of a severe allergic reaction, such as shortness of breath or trouble swallowing, call 911.

General information only; no medical, professional, or legal advice

Content on the Site is for general information. It is not medical, dermatological, pharmaceutical, legal, regulatory, or professional advice, and it does not create a doctor and patient relationship or any other professional relationship. Do not delay or skip care from a doctor or dermatologist because of something you read on the Site. Results from skin care products vary from person to person. We do not say that any product, ingredient, or routine is safe for you, or that it will work for you.

Testing a new product, and skin reactions

Where the Site describes the American Academy of Dermatology's at-home test for a new skin care product, it does so as general information, in the AAD's words. An at-home test can help predict a reaction, but it cannot rule one out, and it is not the medical test called patch testing that a dermatologist may do. Where the Site describes when to see a dermatologist, or what the AAD or the FDA says to do about a reaction, it does so as general information only.

Cosmetics, drugs, and sunscreen

Under U.S. law, whether a product is a cosmetic, a drug, or both depends on its intended use. The Site describes moisturizers as cosmetics, and moisturizers and makeup marketed with sun-protection claims as both cosmetics and drugs, in the FDA's words. The Site does not claim that any product or ingredient treats, cures, prevents, heals, or repairs any disease or condition, including acne, eczema, rosacea, or dry skin, or that any product removes wrinkles, increases collagen, or reverses aging, and nothing on the Site should be read that way. Where the Site describes an FDA definition, an example of a drug claim, or the FDA sunscreen monograph (OTC Monograph M020), it does so for general information only and does not say that any product meets it. The FDA does not approve cosmetics before they go on the market, and a mention on the Site does not mean that any product is approved, cleared, or registered by the FDA.

Labels, claims, and shelf life

Where the Site explains label terms such as "hypoallergenic," "noncomedogenic," "oil free," "fragrance-free," "unscented," "gel cream," or "cosmeceutical," it explains what the FDA or the AAD says about the term. It does not say that any product's label claim is true. Where the Site describes shelf life, expiration dates, or storage, it does so as the FDA states it. The Site does not tell you how long any product will last, and it does not tell you what the law requires of any maker, seller, or business.

Makers' labels and instructions

Moisturizers, sunscreens, and other skin care products are made and sold by third parties under their own terms. Their labels, Drug Facts labels, directions, and warnings control over anything on the Site. Brands may change a formula or a label at any time. We have not tested any product. We are not responsible for any third party's products, labels, claims, instructions, or recalls.

Agencies, organizations, and sources

Government agencies and medical associations named on the Site, including the U.S. Food and Drug Administration (FDA) and the American Academy of Dermatology (AAD), and the dermatologists quoted in AAD materials, are credited for their own guidance and definitions. They do not endorse the Site, and the Site's mention of a source is not a statement that any product is approved, recommended, safe, or effective.

The Site name

"Face Moisturizer" is the name of the Site. It is not the name of a product we make or sell, and it is not a statement about any product.

Brand names and trademarks

Brand, product, program, and organization names mentioned on the Site belong to their owners. We use them only to credit their own guidance. The Site is not affiliated with, sponsored by, or endorsed by any brand or organization it mentions.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PURCHASE FROM A THIRD PARTY, OR THE USE OF ANY MOISTURIZER, SUNSCREEN, COSMETIC, DRUG, OR OTHER SKIN CARE PRODUCT, OR ANY REACTION TO ONE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

Indemnification

You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

Dispute resolution; binding arbitration; class-action waiver

Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.

Assignment and change of operator

We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.

Miscellaneous

These Terms, with the Privacy Policy, the Consumer Health Data Privacy Policy, and the Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
